3.7. Where instruction or instructor services for courses in Austria are ordered separately from the travel package, the Provider of such services is SNOWSPORTS Skalka s.r.o.

3.8. When arranging residential school courses and trips in Austria, SNOWSPORTS s.r.o. acts as a commercial agent of the tour operator identified in the relevant offer or package travel contract.

3.9. The Customer concludes the package travel contract directly with the relevant tour operator. The accommodation, transport, catering, ski passes, payment terms, amendments and cancellation of the package are governed by the package travel contract and the tour operator’s terms and conditions.

3.10. SNOWSPORTS s.r.o. is neither the organiser of the package nor the provider of the individual travel services included in it, unless expressly stated otherwise in the relevant offer or contract. In relation to such a package, these Terms and Conditions govern only the intermediation activities of SNOWSPORTS s.r.o. and the services provided separately by one of the SNOWSPORTS companies.

4. Definitions

4.1. The “Provider” means the company listed in Article 2 which, pursuant to Article 3 or an individual confirmation, provides the particular ordered service.

4.2. The “Customer” means a natural or legal person ordering a service for themselves or for one or more other persons. The Customer may be, in particular, a client, the legal guardian of a minor Participant, a school, educational institution, municipality, employer or another organisation.

4.3. The “Consumer” means a natural person who, when concluding and performing the contract, does not act within the scope of their business, trade or profession.

4.4. The “Participant” means a person taking part in an ordered lesson, course or other sporting activity. The Customer and the Participant may be the same person.

4.5. The “Service” means a lesson, course, instruction, provision of instructors, intermediation or another service offered under the SNOWSPORTS brand.

4.6. An “Individual Arrangement” means a quotation, order confirmation, contract, order accepted by the Provider or another demonstrable agreement between the Provider and the Customer.

4.7. A “Resort” means a ski resort, sports facility or another venue at which the Service is provided. The operator of the Resort is an independent entity and is not automatically responsible for services provided by the SNOWSPORTS companies. Likewise, the SNOWSPORTS companies are not responsible for the operation of the Resort unless they operate it themselves.

II. ORDERING AND PAYMENT TERMS

5. Methods of Ordering a Service

5.1. A Service may be ordered using the method specified in the relevant offer, in particular:

a) in person at the SNOWSPORTS office at the relevant Resort,

b) by telephone using the central contact number or the contact details of the relevant Resort,

c) by email,

d) through a booking or order form on the SNOWSPORTS website,

e) by another method individually agreed with the Provider.

5.2. Schools, educational institutions and other organisations generally order school winter sports courses and inline skating courses by email, based on an offer or previous communication with the Provider.

5.3. The Customer must provide complete and accurate information necessary for the preparation and provision of the Service. If the Customer orders a Service for other persons, the Customer is responsible for the accuracy of the information provided and for being authorised to place the order on their behalf.

5.4. Before confirming the order, the Provider may request additional information, particularly the number and age of Participants, their ability level, the required type and scope of instruction, the date, location, need for equipment hire or invoicing details.

6. Preliminary Enquiry and Binding Order

6.1. A form or communication identified as a preliminary enquiry, non-binding enquiry or request for a quotation does not constitute a binding order or the conclusion of a contract.

6.2. An automated acknowledgement of receipt of a form or email confirms only that it has been delivered to the Provider. It does not constitute confirmation of a date, instructor availability or conclusion of a contract unless expressly stated otherwise.

6.3. A form concerning school courses in Austria constitutes a preliminary enquiry regarding an offer. A package travel contract is concluded only in the manner specified in the draft contract, package travel contract or terms and conditions of the relevant tour operator.

6.4. Before confirming an order, the Provider may verify its capacity, instructor availability, operating conditions, suitability of the requested location and any other circumstances necessary for providing the Service.

6.5. Submission of a preliminary enquiry does not entitle the Customer to receive the Service on the requested date, within the requested scope or at the preliminarily stated price.

7. Order Confirmation and Conclusion of the Contract

7.1. The contract between the Customer and the Provider is concluded when the Provider confirms the order, unless otherwise stated for the particular Service or in an individual offer.

7.2. For an in-person or telephone lesson booking, the Provider may confirm the order orally. For an order placed by email or through a form, the Provider will generally confirm the order by email or through another demonstrable form of electronic communication.

7.3. An order for a school winter sports course, inline skating course or separately provided instructor services becomes binding upon its written confirmation by the Provider or upon another express written acceptance of the conditions by both parties.

7.4. Depending on the nature of the Service, the order confirmation or individual offer specifies in particular the Provider, type and scope of the Service, date, location, number of Participants or instructors, price or method of calculating the price, and payment terms.

7.5. If the Provider’s confirmation contains a change to the Customer’s original request, it constitutes a new offer. The contract is concluded only when the Customer accepts it.

7.6. The Customer must check the information stated in the order confirmation and notify the Provider of any discrepancies without undue delay.

7.7. The Provider may refuse to confirm an order, particularly due to insufficient capacity, unavailability of instructors, unsuitable operating or safety conditions, incomplete information or failure to make a required payment within the specified period.

8. Price and Payment Terms

8.1. The price of the Service is determined in accordance with the Provider’s current price list or an individual quotation accepted by the Customer.

8.2. All prices are stated in euros. A price communicated to a Consumer is the final price and includes all taxes and charges payable by the Customer to the Provider, unless expressly stated otherwise for the particular Service.

8.3. Where the Provider is SNOWSPORTS s.r.o., the stated price includes VAT unless an offer intended for a business or legal person expressly states that the price excludes VAT. SNOWSPORTS Krahule s.r.o., SNOWSPORTS Salamandra s.r.o. and SNOWSPORTS Skalka s.r.o. are not registered for VAT.

8.4. Lessons at the Resorts may be paid for in cash or by payment card at the relevant SNOWSPORTS office. Another payment method may be agreed in the order confirmation.

8.5. School winter sports courses, inline skating courses and separately provided instructor services are generally paid for by bank transfer based on an issued invoice or in accordance with the payment terms stated in the individual offer.

8.6. For selected Services, the Provider may require a deposit or advance payment. The amount and due date will be stated in the offer or order confirmation.

8.7. If the Customer fails to make a required payment within the specified period, the Provider may request payment and suspend the provision of the Service until the amount has been paid. If a deadline for retaining the booking was specified in advance, the booking may expire once that deadline has passed.

8.8. A change to the price list does not affect the price of an order that has already been confirmed. The price may change if the Customer subsequently requests a change to the scope of the Service, number of Participants, number of instructors, date or other material conditions.

8.9. Unless expressly stated otherwise in the relevant offer or order confirmation, the price does not include a ski pass, sports equipment, transport, venue hire, admission fees or other third-party costs.

9. Changes to an Order

9.1. The Customer must notify the Provider of any requested change to an order without undue delay, generally by email or telephone using the contact details of the relevant office.

9.2. A change to the date, location, scope of the Service, number of Participants or other conditions of the order becomes effective only after it has been confirmed by the Provider.

9.3. The Provider may refuse a requested change, particularly if it cannot be accommodated for capacity, organisational, operational or safety reasons.

9.4. If a change to the order affects the scope or price of the Service, the Customer must pay the price corresponding to the newly confirmed scope of the order.

9.5. For school winter sports courses, inline skating courses and separately ordered instruction or instructor services, the Customer must notify the Provider of the final number of Participants, required number of instructors and scope of instruction by the agreed deadline. Subsequent changes may affect the price or the Provider’s ability to provide the Service.

9.6. Changes concerning a package or stay in Austria are governed by the conditions of the tour operator with which the Customer concludes the contract. Changes to separately ordered instruction or instructor services are governed by these Terms and Conditions.

10. Cancellation by the Customer

10.1. The Customer may cancel an order by email or telephone using the contact details of the relevant office or Provider.

10.2. The Customer may cancel a private or group lesson without a cancellation fee no later than two hours before its scheduled start.

10.3. If a lesson is cancelled less than two hours before its scheduled start, the Provider may charge a cancellation fee of up to 50% of the price of the ordered lesson.

10.4. If the Customer fails to attend a lesson without cancelling it in advance, the Customer is not entitled to a refund of any amount already paid. If the lesson was not paid for in advance, the Provider may require reimbursement of the costs incurred in arranging the lesson, up to the full price of the ordered lesson.

10.5. Cancellation of a school winter sports course, inline skating course or separately ordered instruction or instructor services is governed by the conditions stated in the confirmed order or individual quotation. If no specific cancellation conditions were agreed, the Customer must reimburse the Provider for demonstrable costs incurred in arranging the Service.

10.6. Cancellation of a package or stay in Austria is governed by the package travel contract and the terms and conditions of the tour operator with which the Customer concluded the contract. When arranging this Service, SNOWSPORTS s.r.o. acts as the commercial agent of the tour operator.

10.7. An order is considered cancelled at the time when the cancellation notice is received by the Provider.

11. Cancellation or Change by the Provider

11.1. The Provider may cancel, interrupt, shorten or change the date, location or organisational arrangements of a Service, particularly due to adverse weather, unsuitable snow or surface conditions, closure of a Resort or venue, technical failure, an insufficient number of Participants, instructor unavailability or other circumstances beyond the Provider’s reasonable control.

11.2. The Provider will inform the Customer of any material change or cancellation without undue delay using the contact details provided in the order.

11.3. Where possible, the Provider will offer the Customer an alternative date, replacement instructor, change of location or another reasonable alternative.

11.4. If the Provider cancels a Service and the Customer does not accept the offered alternative, the Provider will refund any amount already paid for the part of the Service that was not provided. This does not apply if the specific conditions of the confirmed order provide for another form of compensation.

11.5. A change of a particular instructor does not constitute cancellation of the Service if the Provider supplies another instructor with appropriate qualifications.

11.6. If a Service cannot take place or continue for a reason attributable to the Customer or Participant, particularly late arrival, unsuitable equipment, medical unfitness or failure to comply with the instructor’s directions, this does not constitute cancellation by the Provider.

11.7. Changes to or cancellation of a package or stay in Austria are governed by the package travel contract and the terms and conditions of the relevant tour operator.

III. GENERAL CONDITIONS OF PARTICIPATION

12. Participant’s Medical Fitness

12.1. Each Participant must be medically fit to take part in the ordered sporting activity. The Customer or the child’s legal guardian is responsible for assessing the Participant’s medical condition before the Service begins.

12.2. The Customer must inform the Provider or instructor in advance of any medical restrictions, allergies, injuries, essential medication or other circumstances that may affect the safe conduct of the instruction.

12.3. The Provider may refuse the participation of a person whose medical condition clearly prevents them from safely taking part in the activity or may endanger the Participant, other Participants or the instructor.

12.4. A Participant must not take part in a Service while under the influence of alcohol, narcotic or psychotropic substances, or medication that materially impairs their ability to move and react safely.

12.5. If a Participant experiences medical difficulties or suffers an injury during the activity, they must inform the instructor immediately. The instructor may interrupt or terminate the Participant’s involvement if necessary to protect their health or safety.

12.6. The interruption or termination of a Service for medical reasons attributable to the Participant does not in itself entitle the Customer to a refund for the Service already provided or reserved. Following an individual assessment, the Provider may offer an alternative arrangement.

13. Equipment and Protective Gear

13.1. The Customer is responsible for providing suitable, functional and correctly adjusted sports equipment. Equipment is not included in the price of the Service unless expressly stated otherwise in the order or quotation.

13.2. The Participant must wear clothing and use equipment appropriate for the activity, weather, conditions and their body size. For skiing or snowboarding, this includes in particular suitable skis or a snowboard, ski or snowboard boots, poles where required, gloves and a protective helmet.

13.3. When inline skating, the Participant must use suitable inline skates, a protective helmet and knee, elbow and wrist protection.

13.4. A protective helmet is compulsory for all children participating in skiing, snowboarding or inline skating instruction. The Provider strongly recommends its use by adult Participants.

13.5. The instructor may refuse the use of equipment that is damaged, unsuitable, incorrectly adjusted or capable of endangering the Participant or other persons. If the issue cannot be remedied, the instructor may interrupt or terminate the person’s participation.

13.6. If the Provider arranges or facilitates equipment hire, separate terms and charges of the hire provider may apply. The Customer is responsible for returning the hired equipment at the agreed time and in the agreed condition, allowing for normal wear and tear.

13.7. Time required to obtain, replace or adjust unsuitable equipment belonging to the Participant generally does not constitute grounds for extending the ordered Service.

14. Participant Conduct and Compliance with Instructions

14.1. The Participant must comply with the instructor’s directions, the operating rules of the relevant Resort or sports venue and the general rules of safe conduct applicable to the activity.

14.2. The Participant must behave considerately and adapt their speed and manner of movement to their abilities, the current conditions and the presence of other persons.

14.3. The Customer must provide accurate information about the Participant’s ability and experience. After a practical assessment, the instructor may transfer the Participant to a more suitable group or adapt the content of the instruction to the Participant’s actual ability.

14.4. During group instruction, the Participant must respect the pace, organisation and selected content of the lesson. The Provider does not guarantee that all Participants in the group will achieve the same level of progress.

14.5. The Participant must not intentionally or negligently endanger themselves, the instructor, other Participants or any other person.

14.6. The instructor may issue a warning, temporarily exclude a Participant from the activity or terminate their participation if the Participant repeatedly disregards instructions, disrupts the lesson or creates an unreasonable risk.

14.7. If participation is terminated due to a breach of the Participant’s obligations, the Customer is not entitled to a refund for the unused part of the Service.

14.8. The legal guardian must explain appropriate rules of conduct to the child and inform the Provider of any circumstances that may affect the child’s ability to cooperate or participate safely in the instruction.

15. Participation and Handover of Children

15.1. A minor may participate in a Service based on an order placed or consent granted by their legal guardian, school, nursery school or another authorised person responsible for the child.

15.2. The legal guardian or another responsible person must bring the child to the agreed location on time, prepared for the start of the instruction and equipped with suitable equipment.

15.3. The Provider’s responsibility for supervising the child begins when the child is personally handed over to the instructor at the agreed location and continues for the duration of the ordered instruction.

15.4. At the end of the instruction, the legal guardian or another responsible person designated in advance must collect the child on time at the agreed location. If that person is delayed, they must contact the Provider or relevant office without delay.

15.5. A child may leave without an accompanying adult after the instruction only with the prior express consent of their legal guardian communicated to the Provider.

15.6. For school winter sports courses and inline skating courses, the arrangements for handing over children, supervision outside the instruction and communication with legal guardians are determined by agreement with the school or nursery school.

15.7. If the legal guardian or another responsible person fails to collect the child at the agreed time and cannot be contacted, the Provider will act appropriately in the circumstances and in the child’s best interests. The Provider may require the Customer to reimburse the costs of any necessary additional supervision.

16. Duration of the Service, Arrival and Delays

16.1. The duration of the Service is stated in the current price list, confirmed order or individual quotation.

16.2. Where the scope of instruction is expressed in teaching hours, one teaching hour lasts 50 minutes unless expressly agreed otherwise.

16.3. The Participant must arrive at the agreed location sufficiently in advance, prepared and with complete equipment, so that the instruction can begin at the agreed time.

16.4. A Participant’s late arrival generally does not entitle them to an extension of the Service, a later finishing time or a proportionate reduction in price.

16.5. If the instructor is late, the Provider will, where possible, extend the Service by the corresponding period, offer an alternative date or provide an appropriate price reduction.

16.6. Appropriate breaks may be included during multi-hour or full-day instruction, particularly with regard to the Participants’ age, weather, physical demands and organisational conditions. The specific arrangements are determined by the instructor or by agreement with the Customer.

16.7. Time spent travelling during the instruction, using a cable car or ski lift and carrying out the necessary organisation of Participants forms part of the ordered duration of the Service.

17. Liability for Damage and Personal Belongings

17.1. The Provider is liable for damage caused by a breach of its statutory or contractual obligations to the extent prescribed by generally binding legislation.

17.2. Participation in skiing, snowboarding and inline skating involves risks inherent in sporting activities. The Participant must adapt their conduct to their abilities, medical condition, terrain, surface and current conditions.

17.3. The Provider is not liable for damage caused exclusively by the Participant’s actions, failure to comply with the instructor’s directions, use of unsuitable or damaged equipment, the actions of a third party or circumstances beyond the Provider’s reasonable control.

17.4. The Participant or their legal guardian is liable, in accordance with applicable legislation, for damage caused by the Participant’s intentional conduct or breach of their obligations.

17.5. The Provider is not responsible for the operation, technical condition or decisions of the operator of a ski resort, cable car, ski lift, sports venue, accommodation facility, equipment hire provider or another independent supplier.

17.6. Participants are responsible for looking after their personal belongings. The Provider is not liable for their loss, theft or damage unless the Provider accepted them for safekeeping or caused the damage by breaching its obligations.

17.7. Any accident, damage or other extraordinary incident must be reported to the instructor or Provider without delay so that the circumstances can be recorded and any necessary assistance can be arranged.

17.8. The Provider recommends that Participants obtain appropriate accident and third-party liability insurance corresponding to the nature of the activity undertaken.

18. Photography and Audiovisual Recordings

18.1. The Provider may take photographs and audiovisual recordings during instruction or an event only in accordance with applicable legislation and personal data protection requirements.

18.2. The Provider may use recordings in which a particular Participant can be identified for marketing and presentation purposes, particularly on the basis of the Participant’s consent or the consent of their legal guardian where such consent is required.

18.3. Consent to the use of photographs or recordings for marketing purposes is voluntary and is not a condition for receiving the ordered Service.

18.4. Consent may be withdrawn at any time in the manner specified in the information concerning the processing of personal data. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

18.5. For school winter sports courses and inline skating courses, the school or nursery school must inform the Provider in advance whether and to what extent Participants may be photographed or recorded. The Provider will respect any restrictions communicated to it.

18.6. The taking of photographs or recordings by Participants or accompanying persons must not disrupt the instruction, compromise safety or unreasonably interfere with the rights of other persons.

18.7. Further information concerning the processing of personal data is provided in the separate Privacy Policy published on the Provider’s website.

IV. SPECIFIC CONDITIONS FOR INDIVIDUAL SERVICES

19. Private and Group Skiing and Snowboarding Lessons

19.1. Private and group skiing and snowboarding lessons are provided at the Resorts, on the dates and at the times stated in the current offer and subject to the operating capacity of the relevant SNOWSPORTS office.

19.2. A private lesson is intended for one Participant or a closed group of persons who order the Service together. The price is determined according to the current price list and the number of Participants.

19.3. An open group lesson is intended for individuals assigned to a group by the Provider according to their age, ability level, chosen sport and available capacity. It is not intended as a lower-priced substitute for a private lesson ordered by a pre-arranged closed group.

19.4. An open group lesson will take place once the minimum number of Participants stated in the current offer has registered. If the required number is not reached, the Provider may offer an alternative date, a private lesson subject to payment of the applicable price difference, or a refund of the amount paid.

19.5. Group allocation is based on the information provided by the Customer and the instructor’s assessment. If there is a significant difference in the Participants’ abilities or skill levels, the Provider may propose reassignment, a change of date or another suitable form of instruction.

19.6. If the number of Participants in a private lesson changes, the price will be adjusted according to the actual number of Participants and the current price list. Any increase in the number of Participants must be confirmed by the Provider in advance.

19.7. A ski pass, admission to the venue, equipment hire and other related costs are not included in the lesson price unless expressly stated otherwise.

19.8. The specific meeting point, starting time and contact details of the relevant office are communicated to the Customer in the order confirmation or published on the Provider’s website.

20. Evening Lessons

20.1. Evening lessons are provided only on selected dates and at selected Resorts, subject to current operating, snow and staffing conditions.

20.2. Evening lessons are intended for advanced skiers and snowboarders who safely master the basic technique, can use a ski lift independently and are able to ski or snowboard on an open slope under evening skiing conditions.

20.3. The Provider may refuse the participation of a beginner or a person whose abilities are not appropriate for evening instruction and may recommend a more suitable lesson during daytime operation.

20.4. Evening lessons must be booked in advance. The SNOWSPORTS office at the Krahule resort is not open during evening skiing. The booking and all organisational arrangements must therefore be completed during daytime operation or through the published contact details.

20.5. Grooming of the slope before evening skiing and its current condition do not guarantee that a lesson will take place. The Provider may change or cancel the lesson for safety or operational reasons in accordance with Article 11 of these Terms and Conditions.

20.6. All provisions of these Terms and Conditions relating to private and group lessons apply accordingly to evening lessons.

21. School Winter Sports Courses in Slovakia

21.1. School winter sports courses in Slovakia are provided by SNOWSPORTS Skalka s.r.o. based on an order placed by a school, nursery school or another Customer and confirmed by email.

21.2. The Service consists of skiing or snowboarding instruction provided by the agreed number of instructors. The specific location, date, scope of instruction, number of instructors and price are stated in the confirmed order or quotation.

21.3. One teaching hour lasts 50 minutes unless otherwise agreed in the confirmed order. Subject to the Provider’s available capacity, the Customer may choose the number of days, daily scope of instruction and number of instructors.

21.4. By the agreed deadline, the Customer must provide the final number and age of Participants, their allocation between skiing and snowboarding, their ability levels and all material medical or organisational information.

21.5. The Provider assigns Participants to instructional groups in consultation with the Customer, particularly according to age, chosen sport and ability level. The Provider may adjust the allocation during the course if necessary to ensure appropriate and safe instruction.

21.6. The Customer is responsible for pedagogical and organisational supervision of the children outside the time during which the respective groups have been handed over to the instructors for instruction. The arrangements for handing over and collecting the groups will be agreed before the course begins.

21.7. Unless otherwise agreed, the Customer must ensure that Participants arrive for instruction on time, with suitable equipment and a valid ski pass or admission ticket, and are ready to begin the activity.

21.8. Unless expressly included in the confirmed order, the price generally does not include transport, accommodation, meals, ski passes, admission fees, equipment hire or other third-party services.

21.9. A change in the number of Participants, instructors or ordered teaching hours may result in a change to the total price. The scope of the Service confirmed by the Provider is decisive.

21.10. If the course cannot take place or continue due to closure of the Resort, unsuitable conditions or another circumstance beyond the Provider’s reasonable control, the Provider and the Customer will agree on an alternative date, an adjustment to the scope or a financial settlement for the part of the Service that was not provided.

22. One-Day School Skiing Courses at Wexl Arena

22.1. One-day school skiing courses at Wexl Arena in Austria are provided by SNOWSPORTS Skalka s.r.o. based on an order placed by a school or nursery school and confirmed by email.

22.2. The courses are organised as one-day trips from Bratislava without accommodation. The specific number of days, dates, timetable, scope of instruction and number of instructors are determined in the confirmed order or quotation.

22.3. The Provider is responsible for the professional and organisational management of the sporting part of the course, the allocation of Participants to groups and skiing instruction provided by the agreed number of instructors.

22.4. The scope of transport and other organisational services is determined individually. Unless the order expressly states that transport is arranged by the Provider, the school or other Customer is responsible for booking and paying for the transport and for its operation.

22.5. By the agreed deadline, the Customer must provide the final number and age of Participants, their skiing ability levels, the required number of instructors and all medical or organisational information material to the course.

22.6. The Customer is responsible for pedagogical supervision during transport and outside the period of sporting instruction. During instruction, each instructor is responsible for the group handed over to them within the scope of the agreed Service.

22.7. The price includes only the Services expressly stated in the confirmed order. Ski passes, transport, meals, equipment hire and other costs are not included unless agreed otherwise.

22.8. The Customer must ensure that Participants have the documents required to travel to Austria, appropriate insurance and that they meet all other requirements for participation in the trip abroad.

22.9. If the course cannot take place due to unsuitable conditions, closure of the Resort, transport restrictions or another circumstance beyond the Provider’s reasonable control, the Provider and the Customer will agree on an alternative date, an adjustment to the scope or a settlement of any amount already paid for Services that were not provided.

22.10. The provisions of Article 21 of these Terms and Conditions apply accordingly to one-day courses at Wexl Arena unless this Article provides otherwise.

23. Residential School Courses in Austria in Cooperation with NEV-DAMA

23.1. SNOWSPORTS s.r.o. arranges offers for residential school courses in Austria in cooperation with a tour operator operating under the NEV-DAMA brand.

23.2. SNOWSPORTS s.r.o. acts in relation to this Service as a commercial agent of the tour operator. The organiser of the package and its full identification are stated in the relevant offer and package travel contract.

23.3. The school or other Customer concludes the package travel contract directly with the tour operator. SNOWSPORTS s.r.o. is neither the organiser of the package nor the provider of the individual travel services included in it.

23.4. The package may include accommodation, meals, transport, ski passes, other services connected with the stay or other performance stated in the relevant offer. Their scope, price and conditions are governed by the package travel contract and the tour operator’s terms and conditions.

23.10. The Customer must provide the information and cooperation necessary to prepare the offer and conclude the package travel contract. For this purpose, necessary information may be transferred to the relevant tour operator in accordance with personal data protection requirements.

24. Inline Skating Courses

24.1. Inline skating courses are provided by SNOWSPORTS Skalka s.r.o. unless otherwise stated in the individual offer or order confirmation.

24.3. The specific location, date, number of lessons, duration of instruction, number of Participants, number of instructors and price are determined by the current offer or confirmed order.

24.4. If a course is to take place on the Customer’s premises, the Customer must provide a suitable, sufficiently large, level and safe surface free of obstacles, together with appropriate access to the location. The Provider may assess the suitability of the premises in advance.

24.5. The Provider may refuse to provide instruction or propose a change of location if the surface, weather, spatial conditions or other circumstances do not allow the course to take place safely.

24.6. Participants must have suitable inline skates, a protective helmet and knee, elbow and wrist protection. The Provider may arrange equipment hire for an additional charge if it was ordered in advance and the required size is available.

24.10. For courses ordered by a school or nursery school, the division of responsibility for supervising children is governed accordingly by Articles 15 and 21 of these Terms and Conditions. The school or nursery school is responsible for supervision outside the time during which the respective group has been handed over to the instructor for instruction.

25. Vouchers and Employee Benefit Programmes

25.1. Selected SNOWSPORTS Services may be paid for using a voucher or a supported employee benefit programme where permitted by the current offer and the conditions of the voucher issuer.

25.2. The Customer must inform the Provider when ordering the Service that they intend to use a voucher. The Provider will then verify whether it may be used for the particular Service and at the particular office.

25.3. The use of fpoho vouchers or another employee benefit programme is also governed by the conditions of the relevant issuer. The Provider is not responsible for a voucher being rejected, expiring, restricted or failing to function due to the issuer or the Customer’s failure to comply with the issuer’s conditions.

25.4. If the value of the voucher is insufficient to cover the full price of the Service, the Customer must pay the difference using a method agreed with the Provider.

25.5. If the value of the voucher exceeds the price of the Service, the unused difference will not be paid out in cash unless the conditions of the issuer or the particular voucher provide otherwise.

25.6. A voucher cannot be applied retrospectively to a Service that has already been paid for unless the Provider expressly agrees otherwise with the Customer.

25.7. The refunding or restoration of a voucher’s value following cancellation of a Service is governed by the issuer’s conditions and the technical capabilities of the relevant employee benefit programme.

V. COMPLAINTS AND DISPUTE RESOLUTION

26. Making a Complaint

26.1. The Customer has the right to report a defective Service if the Service was not provided properly, within the agreed scope or in accordance with the confirmed order.

26.2. A defect should be reported without undue delay after it is discovered and, where possible, directly while the Service is being provided so that the Provider can arrange immediate corrective action.

26.3. A complaint may be made in person at the relevant office or by email at office@snowsports.sk. The complaint must be addressed to the company that provided the Service concerned.

26.4. The Customer should include in the complaint their name and contact details, identification of the Service, the date and place where it was provided, a description of the reported defect and the requested remedy. Where possible, the Customer should also provide the order confirmation, proof of payment or other documents necessary to assess the complaint.

26.5. The Provider will issue the Customer with written confirmation of the reported defect without undue delay. The confirmation will state a reasonable period within which the Provider will remedy the defect or assess the complaint.

26.6. The period communicated to a Consumer should generally not exceed 30 days from the date on which the defect was reported. A longer period is permitted only where justified by an objective circumstance beyond the Provider’s control.

26.7. If the complaint is justified, the Provider will provide an appropriate remedy according to the nature of the defect, particularly repeat performance of the Service, completion of the missing performance, an appropriate price reduction or a refund of the corresponding part of the price.

26.8. The Provider will inform the Customer of the outcome of the complaint and the manner in which it was resolved in writing or by email.

26.9. Complaints concerning services included in a residential package in Austria must be submitted to the tour operator in accordance with the package travel contract and the tour operator’s terms and conditions. 27.7. The Provider and a Customer who is not a Consumer will first attempt to resolve any dispute by mutual agreement. This does not affect either party’s right to bring the matter before a competent court.

28. Consumer Withdrawal from a Distance Contract

28.1. This Article applies only to a Customer who is a Consumer and who concluded a contract at a distance or away from the Provider’s business premises.

28.2. In the case of a contract concluded at a distance or away from the Provider’s business premises, the Consumer has the right to withdraw from the contract without giving a reason within the statutory period unless generally binding legislation provides for an exception.

28.3. The 14-day right of withdrawal does not apply to the provision of a Service connected with leisure activities where the contract requires the Service to be provided at a specific time or within a specific period.

28.4. The exception under Clause 28.3 applies in particular to lessons, courses and other sporting activities booked for a specific date, time or predetermined period. Cancellation of such a Service is governed by the cancellation conditions set out in Article 10 of these Terms and Conditions.

28.5. If the exception under Clause 28.3 does not apply to the ordered Service, the Consumer may withdraw from the contract within 14 days of its conclusion by sending an unambiguous notice to the Provider.

28.6. If the Consumer expressly requested that the provision of the Service begin before the expiry of the withdrawal period and subsequently withdraws from the contract, the Consumer must pay the price for the performance actually provided up to the date on which the withdrawal notice was delivered.

28.7. If the Service was fully provided before the expiry of the withdrawal period based on the Consumer’s express consent and the Consumer was informed in advance that the right of withdrawal would be lost, the Consumer’s right of withdrawal expires once the Service has been provided in full.

28.8. The Consumer may send the withdrawal notice by email to office@snowsports.sk or by post to the registered office of the relevant Provider.

29.5. If a dispute cannot be resolved by agreement, it will be decided by the court having subject-matter and territorial jurisdiction under applicable legislation.

30.4. A particular order is governed by the version of the Terms and Conditions effective at the time when the order is bindingly confirmed unless the Provider and the Customer expressly agree otherwise.

30.5. A newer version of the Terms and Conditions does not apply retrospectively to orders that have already been confirmed if doing so would adversely affect the Customer without their consent.

30.6. If any provision of these Terms and Conditions becomes invalid, ineffective or unenforceable, this does not affect the validity and effect of the remaining provisions.
